Terms for Job Seekers (Candidates)
These terms govern your use of SecureMatch as a job seeker looking for employment opportunities.
1. Agreement to Terms
By creating an account and using SecureMatch ("Platform", "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and SecureMatch Pty Ltd ("we", "us", "our").
If you do not agree to these Terms, you must not use the Platform. We reserve the right to modify these Terms at any time, with notice provided via email or platform notification.
2. Eligibility
To use SecureMatch as a candidate, you must:
- Be at least 18 years of age
- Be legally entitled to work in Australia
- Provide accurate and truthful information
- Not be prohibited from using the service under Australian law
3. Your Account
3.1 Account Creation
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3.2 Profile Information
You agree that all information in your profile is:
- Accurate: Truthful representation of your skills, experience, and qualifications
- Current: Up-to-date and reflective of your present situation
- Your Own: You have the right to share the information provided
- Lawful: Does not violate any laws or third-party rights
3.3 Licenses and Certifications
If you claim to hold any licenses, certifications, or qualifications (e.g., RSA, White Card, First Aid Certificate), you warrant that you currently hold valid versions of these credentials. Misrepresenting qualifications may result in account termination and may have legal consequences.
4. How SecureMatch Works
4.1 Privacy-First Model
SecureMatch operates on a privacy-first model. Your personal contact details (full name, email, phone, resume) are only visible to employers after you accept their connection request. By accepting a connection, you consent to sharing your private profile with that employer.
4.2 Connection Requests
When an employer sends you a connection request, you may accept or decline. You are under no obligation to accept any request. Declined requests will not be notified to the employer.
4.3 Connection Expiry
Connection requests expire after 7 days if not actioned. You can manage pending requests through your dashboard.
5. Premium Subscription
5.1 Free vs Premium
SecureMatch offers both free and premium tiers for candidates:
- Free: Basic profile, photo upload, connection requests, messaging
- Premium ($9.99/month): Video introduction, portfolio gallery, profile analytics, priority visibility
5.2 Billing and Cancellation
Premium subscriptions are billed monthly. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. Refunds are provided in accordance with Australian Consumer Law.
5.3 Australian Consumer Guarantees
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a remedy if services are not provided with due care and skill.
6. Acceptable Use
You agree NOT to:
- Provide false, misleading, or fraudulent information
- Misrepresent your qualifications, skills, or work history
- Use the platform for any unlawful purpose
- Harass, abuse, or threaten other users
- Attempt to gain unauthorised access to other accounts
- Scrape, harvest, or collect data from the platform
- Use automated systems or bots to interact with the platform
- Circumvent any security features of the platform
- Use the messaging system for spam or unsolicited communications
7. Content You Provide
7.1 Your Content
You retain ownership of content you upload (resume, photos, videos, portfolio). By uploading content, you grant us a limited license to display and transmit this content to facilitate connections with employers.
7.2 Content Standards
Your content must not:
- Contain defamatory, offensive, or discriminatory material
- Infringe on any third party's intellectual property rights
- Contain malware, viruses, or harmful code
- Include content unrelated to professional employment purposes
8. No Employment Guarantee
SecureMatch is a platform that facilitates connections between job seekers and employers. We do not guarantee employment outcomes. We do not verify employment offers, conduct background checks on employers, or guarantee the legitimacy of any job opportunity. You are responsible for conducting your own due diligence on potential employers.
9. Anti-Discrimination
SecureMatch complies with Australian anti-discrimination laws. If you believe you have been discriminated against by an employer on the platform based on protected attributes (age, gender, race, disability, religion, etc.), you may report the incident to us and/or lodge a complaint with the Australian Human Rights Commission.
10. Termination
We may suspend or terminate your account if you:
- Violate these Terms of Service
- Provide false or misleading information
- Engage in fraudulent or illegal activity
- Harass or abuse other users
You may delete your account at any time through your account settings. Upon deletion, your profile will be removed and active connections will be terminated.
11. Limitation of Liability
To the maximum extent permitted by law, SecureMatch is not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. This includes, but is not limited to, loss of employment opportunities, loss of income, or damages resulting from interactions with employers on the platform.
12. Governing Law
These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of the platform will be subject to the exclusive jurisdiction of the courts of Australia.
